AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CLEARLAKE
ADDING CHAPTERS 18-8, 18-10, and 18-11 TO THE CLEARLAKE MUNICIPAL CODE (MARIJUANA CULTIVATION, ABATEMENT OF PUBLIC NUISANCES CREATED BY MARIJUANA CULTIVATION, AND ADMINISTRATIVE REMEDIES) AND REPEALING CHAPTERS 10-7, 10-8, AND 10-9 (COMMERCIAL MEDICAL MARIJUANA CULTIVATION AND CULTIVATION ON VACANT PROPERTIES, AND LIMITING CULTIVATION AMOUNTS, ABATEMENT OF PUBLIC NUISANCES CREATED BY MARIJUANA CULTIVATION, AND ADMINISTRATIVE REMEDIES)

NOTICE IS HEREBY GIVEN that the Clearlake City Council adopted Ordinance No. 181-2016 at the City Council meeting at 14050 Olympic Drive, Clearlake, on February 11, 2016. 

The purpose and intent of this ordinance is to regulate cultivation of marijuana in order to preserve the public peace, health, safety and general welfare of the citizens of the City of Clearlake. 

The ordinance regulates who may cultivate marijuana in the City; where marijuana may be cultivated in the City; as well as amount or size of grows permitted. 

The ordinance provides in part that marijuana cultivation will be limited to outdoor grows on residential properties with a maximum of six plants.

The ordinance establishes other cultivation site requirements and an annual marijuana cultivation permit. 

Further, the ordinance states the establishment, maintenance, or operation of any prohibited cultivation of medical marijuana is declared to be a public nuisance and subject to abatement proceedings. 

The ordinance establishes the abatement procedure, administrative penalty procedure, and appeal processes for said procedures. 

The ordinance was passed and adopted by affirmative vote of Mayor Russell Perdock, Vice Mayor Gina Fortino Dickson, and Council Members Joyce Overton, Denise Loustalot, and Bruno Sabatier.
