Sheriff’s legal representation issue to return to Board of Supervisors for third week

LAKEPORT, Calif. – For the third straight week the Board of Supervisors is scheduled to discuss a request from Sheriff Frank Rivero to provide him with legal representation because of an ongoing investigation by the district attorney into a 2008 shooting in which Rivero was involved.

The meeting will being at 9 a.m. Tuesday, Feb. 28, in the board chambers on the first floor of the Lake County Courthouse, 255 N. Forbes St., Lakeport. TV8 will broadcast the meeting live.

The continued discussion on Rivero’s legal representation is untimed.

Last week, the Board of Supervisors voted unanimously to direct the County Counsel’s Office to analyze creating an “ethical wall” to allow it to represent Rivero in his dispute with District Attorney Don Anderson, who is investigating the shooting.

County Counsel Anita Grant said waivers would be necessary from both Anderson and Rivero in order for her office to represent the sheriff.

While Anderson reportedly had indicated a willingness to waive the conflict of interest, following last week’s meeting Rivero had an attorney contact Grant’s office to say he would not waive the conflict issue, as Lake County News has reported.

In other board business, at 9:15 a.m. the board will hold a public hearing on a proposed land exchange, with county staff recommending exchanging a county-owned property at 14102 E. Highway 20 in Clearlake Oaks for a property at 12555 E. Highway 20, also in Clearlake Oaks, that currently is the location of a tattoo parlor.

The county is pursuing the use of the property at 12555 E. Highway 20 as public parking for the Clarks Island park that is under development, according to a staff report.
